COMES NOW appellate counsel undersigned joined by Assistant U.S. Attorney Hurley and moves the Court to vacate the hearing re: Ameline remand presently set for October 20, 2006. Counsel and AUSA both request permission to proceed by submitting memoranda on the topic of sentencing. Counsel for appellant/defendant additionally advises the Court she has a juvenile case in Pinal County (Florence, AZ) In re Boulier, scheduled for the afternoon of October 20, 2006. Generally, juvenile matters take calendar precedence over all others. Mr. Saavedra-Martinez remains in the custody of the Federal Bureau of Prisons.
