Plaintiff Lemelson Medical, Education & Research Foundation, Limited Partnership ("Lemelson Foundation Partnership") brought action No. CIV 000660 PHX (HRH) in April 2000 against 90 defendants, including VIA Technologies, Inc. ("VIA"). Pursuant to Rule 41(a)(2), Fed.R.Civ.P., the Lemelson Foundation Partnership and VIA now jointly move this Court for entry of an order dismissing with prejudice all pending claims Lemelson Foundation Partnership has against VIA, because those parties have agreed to settlement of those claims.
