No defendant has opposed Lemelson's motion to dismiss with prejudice, and some have joined or supported it. Several defendants (Acterna, Wyman-Gordon, Precision, and Arctic Cat) requested that the Court include Rule 54(b) language in the order of dismissal, but that appears unnecessary because all claims of all parties appear ready for dismissal. Minebea has urged the Court to condition dismissal "upon Minebea's right to seek an award of its reasonable attorneys' fees pursuant to 35 U.S.C. § 285 and in accordance with Rule 54.2 of this Court's Local Rules ...." Such a condition is unnecessary as well, because Minebea has the right to seek fees under the cited rules (and Lemelson can oppose it if it does).

Kohler, Applied Power d/b/a Actuant, and U.S. Can have consented to dismissal of their Counterclaims, but asked that it be without prejudice, and Lemelson has no objection to those requests. Accordingly, Lemelson respectfully requests that the Court grant the motion and dismiss all claims of all parties with prejudice, with the exception that the counterclaims of Kohler, Applied Power d/b/a Actuant, and U.S. Can should be dismissed without prejudice.
