A Petition for Revocation of Supervised Release was filed and Defendant admitted the allegation that he violated Standard Condition #4 and Special Condition #1. The Court found that defendant violated the terms and conditions of supervised release. The Court has considered the U.S. Sentencing Commission Chapter 7 policy statements as well as the original guideline range and 18 U.S.C. ยง3553 and finds as follows: IT IS THE JUDGMENT OF THIS COURT THAT defendant's supervised release is REVOKED. IT IS ORDERED committing defendant to the custody of Bureau of Prisons for a term of SEVEN (7) MONTHS, with credit for time served in custody on this matter. IT IS FURTHER ORDERED sentencing defendant to a term of TWENTY-NINE (29) Months Supervised Release upon defendant's release from custody.

SUPERVISED RELEASE Within 72 hours of release from custody of the Bureau of Prisons, you shall report in person to the Probation Office in the district to which you are released. You shall comply with the standard conditions of supervision adopted in General Order 05-36, of particular importance is you shall not commit another federal, state, or local crime during the term of supervision and the previously imposed special conditions and the following additional special conditions: 1. You shall reside and participate in a residential re-entry center for 180 days, unless discharged earlier by the probation officer. You shall reside in and participate in a 12-step residential substance abuse program for 180 days, unless discharged earlier by the probation officer. You shall abstain from the use of all illicit substances. IT IS FURTHER ORDERED dismissing the remaining allegations of the Petition to Revoke. Defendant is advised of his right to appeal. DATED this 13th day of August, 2007.
