ALEX NIEBLA, by and through undersigned counsel, hereby requests that the Court,

appoint undersigned counsel to represent him in his effort to secure a resentencing of his conviction for the sale of Cocaine Base, which sentences have been reduced by 2 levels. Under the terms of the new guideline Defendant is eligible to be released immediately. Defendant qualifies for appointment of counsel as he has no assets. A copy of Mr. Niebla's financial affidavit is attached for the Court's review. Wherefore, it is requested that the Court appoint undersigned counsel to represent Mr. Niebla.
