Pending before the court is a motion filed by the defendant on June 17, 2004, to vacate, set aside or correct sentence pursuant to 28 U.S.C. § 2255. In the motion, Vazquez-Palacios, claims, among other things, that the grand jury, which indicted him for possession of weapons, heard other evidence against him and refused to indict him for any other crimes. The government filed a response to the motion on September 28, 2005. The court requires additional information to properly evaluate the motion. Accordingly, IT IS ORDERED that the government shall have until January 25, 2006, to submit to the court, in camera, a transcript of the grand jury proceeding which indicted Vazquez-Palacios on October 2, 2003, or that portion of the transcript that relates to this defendant.
