14 The parties have filed a Joint Motion to Extend Time for Filing Memoranda re:
15 Materiality and Protective Order, dated July 28, 2005. The Joint Motion seeks a 30-day
16 extension of deadlines set forth in the Court’s Order of July 11, 2005 (Doc. #750) (the
17 "Order"). The Order established a schedule for resolving outstanding discovery issues and
18 specifically advised the parties that the Court did not intend to extend the schedule absent
19 truly extraordinary circumstances. See Order at 9.
20 The Joint Motion explains that counsel for the Government has experienced a death
21 in his family and that Defendants have recently discovered additional information relevant
22 to the discoveiy disputes. Because the Court regards these developments as extraordinary
232 circumstances, it will grant additional time, but not the 30 days requested by the parties.
24 IT IS HEREBY ORDERED: _
25 1. Defendants’ factual submissions on the issue of materiality under
26 Rule l6(a}(1)(E)(i), as required by section 4 of the Order, shall be tiled on or
27 before August 12, 2005. The Govermnenfs response shall be tiled on or
28 before August 26, 2005.

1 2. The Government’s request for protective orders under Rule 16(d)(1), as
2 required by section 8 ofthe: Order, shall be filed on or before August 12, 2005.
3 Defendants’ response shall be filed on or before August 26, 2005.
4 3. Defendants’ response to the Government’s Notice of Filing the Documents to
5 be Disclosed at a Later Time, dated July 8, 2005, shall be filed on or before
p 6 August 12, 2005. The Government’s response shall be tiled on or before
7 August 26, 2005.
l 8 4. All other dates set forth inthe Order shall remain in effect.
