1. On November 24, 2003, S/A Rutland, S/A M1 and S/A Hoover interviewed
MCHUGH. The interview took place at the Pima County Jail located at 1270 West
[ Silverlake, Tucson, Arizona.

• MCHUGH admitted that he was the one who committed the assault on Daniel
GUTIERREZ, in February of 2003
• the assault occurred at MCHUGH’s house
• MCHUGH advised that he committed the assault because GUTIERREZ was
making sexual advances towards his god·daughter, who is thirteen (13) years
l old - MCHUGH’s god·daughter made a digital recording of GUTlERREZ'
T advances and played it for MCHUGH
L • MCHUGH thinks that law enforcement may be in possession of the recording
` device after recovering it in a search warrant that was conducted there a few .
months ago
• MCHUGH advised that he was the only one present when the assault
occurred and that he drove GUTIERREZ down the road and left him in his
vehicle
' • MCHUGH had known GUTIERREZ for about a month and did not know what
; type of business he was involved in, or what he did for a living
l • MCHUGH denied that the assault was done at the direction of the Tucson
Chapter ofthe HelI's Angels Motorcycle Club - MCHUGH advised several
times that he assaulted GUTIERREZ because of his sexual advances on his
