RESPONSE TO PLAINTIFF'S "REQUEST FOR REINSTITUTION"

Defendant Dora Schriro, in her official capacity as the current Director of the Arizona Department of Corrections, responds in opposition to the document filed by Plaintiff on February 17, 2006, which appears to request that this matter be reinstated. Plaintiff's document is not legible as it is handwritten. Since an underlying issue in this case concerned Plaintiff's access to a typewriter, counsel for the defendant contacted Deputy Warden McWilliams at Special Management Unit II in an effort to determine whether Plaintiff had access to a typewriter. According to the information provided by D.W. McWilliams,

ADC did temporarily confiscate Plaintiff's typewriter in preparation for transferring Plaintiff to a different housing unit. On March 2, 2006, Deputy Warden Patrick R. O'Brien of the new unit, Special Management Unit I, confirmed that ADC is again allowing Plaintiff access to his typewriter. Since Plaintiff now has access to a typewriter again, Defendant asks that the Court stay Plaintiff's request filed February 17, 2006, and direct Plaintiff to file his request in a legible manner. If Plaintiff's request concerned access to the typewriter, then Plaintiff can either withdraw his request or explain why the issue is not moot given his current access to a typewriter.
