Plaintiffs contend that there exists a discovery dispute with regards to (1) the original notes of Annie Preston, who interviewed Plaintiff Jose Ramirez and his attackers; and (2) the last known address of a witness, Defendants' former employee, teacher's aide Dominic Guzman. As a result, Plaintiff seeks an additional thirty days for discovery following the Court's ruling on the Motion To Compel Discovery filed on December 19, 2005 in Ramirez v. Soto, et al., CV 04-2908 ("Ramirez II") (Doc. #33), which was consolidated on January 6, 2006. Defendants claim that they have since provided Plaintiffs with Mr. Guzman's address and stipulate to a 30 day extension of the discovery deadline for the limited purpose of deposing Mr. Guzman.

Pursuant to Defendants' stipulation and good cause appearing, the Court will grant Plaintiffs thirty days from the date of this Order for the limited purpose of deposing Mr. Guzman. With regard to Ms. Preston's notes, the parties are directed to review this Chambers' Instructions on Discovery Disputes (http://www.azd.uscourts.gov) and proceed accordingly. The Court will not rule on Plaintiffs' Motion To Compel at this time. Also pending is Plaintiffs' Motion for Extension of Time To File Pleading Out of Time (Doc. #94). The Court will grant this motion.

Accordingly, IT IS ORDERED that Plaintiffs' Motion For Extension of Time To Complete Discovery (Doc. #96) is GRANTED, in part. IT IS FURTHER ORDERED that Plaintiffs' Motion for Extension of Time To File Pleading Out of Time (Doc. #94) is GRANTED.
