Defendants Carl Brown, and Molly Brown ("Defendants"), respectfully request the Court to schedule oral argument during the month of February 2007, for reasons that involve the economical use of judicial time. The parties are scheduled to participate in a Court ordered settlement conference before Judge Mark T. Aspey, on March 23, 2007 in Flagstaff. Defendants make the request to take advantage of the possibility that a settlement conference may become unnecessary. Defendants make this request because have replied to Plaintiffs' response to Defendants' Cross-Motion for Summary Judgment. Defendants are of the opinion that
