Dear Mr. Clark:
ADHS/DBHS has received yom request for public records on August 19, 2005. Specifically,
you requested the following information: - _,
V l) Summary of disposition of SM] Appeals after denial of SMI determinations by
‘ValueOptions between September 2002 and September 2003, toinclude case number,
appeal tile date, appeal- determination and determination. If possible, determination
stunmary;
2) Any and all information regarding Karen Linnette Marshall, MEd, MAPC,CSAC -— SA-
0956 to include disciplinary records, public Business/Service of Process address and any
other available data;
3) Any and all information, documents, reports, investigation summary reports, etc.
regarding failure to provide care, malpractice, and negligence in reference to
ValueOptions, its employees, and SMI services to include ValueOptions consumers
Loren Spellers and Peter‘Hnbkirk-Frenchs case.
ADHS Policy ADM020 requires us to notify you that there will be a $.25 per page charge for
reproduction, which must be paid in advance of reproduction.
There are 25 pages of information that tit yo1u· description under number 1.
ADHS/DBHS is not in possession of any records that fit your description under number 2.
ADHS/DBHS projects approximately 50 pages of information that fit your request identitied in
number 3. Please be advised, however, that those documents will be largely redactued due to
the fact that ADHS/DBHS is precluded from releasing any clinical information by Arizona
Revised Statutes §36-509. Arizona Revised Statute §36-509 requires that a health care entity,
which by definition includes the Department, keep mental health records and information

contained in records confidential, not as public records. While in most cases, ADHSIDBHS
may accomplish this by redacting the client identifying information from the record, in these
two cases, simply redacting the client identifying information is insufficient to protect against
unauthorized disclosure. Consequently, all clinical information, records and documents will
also be redacted. _
Based upon the size of your request and the redacting process, ADI-IS/DBHS approximates that
your request can be processed within 5 working days from our receipt of your payment.
