(?ValueOptions"), through counsel, hereby submits its Notice of Plaintiff's Failure to Comply with Court Order. On December 8, 2005, this Court entered an Order requiring Plaintiff to return the service packets containing Defendant ValueOptions' statutory address for Defendant Marshall and Defendant Crumbley's home address within twenty (20) days of filing the Order. [Dkt. 180]. Plaintiff failed to do so. This Court also granted Plaintiff's request for an order directing service on Defendant Marshall and Crumbley ?one last time." [Id., p. 23]. This Court specifically stated: ?[I]f service is not properly executed on either defendant within 60 days of the filing of this Order, the action will be dismissed as to each defendant not served pursuant to Rule 4(m) of the Fed.R.Civ.P. and Rule 2.12(b)(3)(B)(i) of the Rules of Practice of the United States District Court (?Local Rules")." Id. As evidenced by Notice of Service of Defendant Karen Marshall by Plaintiff, filed on March 6, 2006, Plaintiff failed to comply with both requirements of this Court's December 8, 2005 Order. [Dkt. 213].
