The Motion was filed on November 9, 2006. [Doc. 285]. Pursuant to LR Civ. 18 7.2(c), the opposing party shall have ten (10) days after service of a matter in which to serve 19 and file a responsive memorandum. Failure of Plaintiff to respond to Defendants' Motion 20 to Strike the Affidavit of Lisa Harnack should, in the discretion of the Court, be deemed as 21 consent to the granting of the Motion without further notice, and judgment should be 22 23 Cir. 1994).
