Defendants JSB Holdings, Inc. ("JSB") hereby moves the Court, in limine, for an

19 Order excluding the decision of the Unemployment Compensation Appeals Tribunal from 20 evidence in this case. The decision, more formally entitled "DES Office of Appeals 21 Decision of Appeal Tribunal" dated April 16, 2003 (by Administrative Law Judge 22 Schwartz), is inadmissible under A.R.S. § 23-672.01. Any finding of fact or law, judgment, conclusion or final order made by a hearing officer, an administrative law judge or any person with the authority to make findings of fact or law in any action or proceeding before the department [Department of Economic Security] or the Appeals Board pursuant to this chapter is not conclusive or binding in any separate or subsequent action or proceeding and shall not be used as evidence in any separate or subsequent action or proceeding between an individual and the individual's present or former employer brought before an arbitrator, court or judge of this state or the United States, regardless of

whether the prior action or proceeding was between the same or related parties or involved the same facts. A.R.S. § 23-672.01 (emphasis added). In light of the foregoing, the Plaintiff should be precluded from using or referring to the Appeals Tribunal decision during the trial of this matter.
