A motion for attorneys fees is pending before the Court in this case. The parties believe they have reached a tentative settlement in this action, and request the Court to allow the parties until February 17, 2006 to complete a final settlement agreement and file a stipulation to dispose of the case. The Court of Appeals for the Ninth Circuit has entered an order providing the parties with a deadline of February 17 to finalize a settlement agreement and file a dismissal of the appeal, a copy of which is attached as Exhibit A.
