14 Without admitting any liability oryfault on the part of any party, the parties hereby
15 stipulate and agree as follows: 1 i
16 1. The route of Letter Carrier Frank Benevidez has been revised northward, eliminating
17 all deliveries along Rose Lane and south of Rose Lane, and plaintiff s townhouse complex.
18 . 2. In consideration of the route change described in Paragraph lwhich eliminates any
19 current impact on mail delivery by the U.S.Postal Service, the parties move the Court to remand
20 this action back to the East Phoenix No. 2 Justice Court, in Court Case number 0702-CV2003-
21 06098 which was removed to this Court without altering the ex parte restraining order entered
22 by the Justice Court August 8, 2003, and to dismiss this action without prejudice, each party to
23 bear its own costs and fees. A form of Order is lodged herewith.
