ORDER APPROVING COMPROMISE SETTLEMENT At Butte in said District this 17th day of November, 2005. Before the Court is the Chapter 7 Trustee's Motion, through counsel, for the approval of a Settlement Agreement entered into between the Trustee, the United States Attorney for the District of Arizona and David W. Brundage. The settlement pertains to certain funds held by the United States of America which are currently subject to a pending forfeiture action in the United States District Court for the District of Arizona. Under the terms of the proposed compromise settlement, the bankruptcy estate will received the approximate sum of $366,171.22 for payment to creditors in this case. Pursuant to Bankruptcy Rules 2002 and 9019, Notice of the proposed settlement was provided to all Parties. No objections or requests for hearing as to the proposed settlement have been filed by any creditor or interested party. Based on the foregoing, the Court finds that the terms of the proposed compromise settlement are fair and equitable and satisfy the requirements of F.R.B.P. 9019(a). IT IS ORDERED the Trustee's Motion to Approve Compromise Settlement, filed with

the Bankruptcy Court on October 24, 2005, is APPROVED and the Trustee is hereby authorized to enter into the Compromise Settlement with the United States Attorney for the District of Arizona and David W. Brundage; and the parties thereto shall henceforth be bound by and shall perform in accordance with the terms of the Compromise Settlement.
