The Court has presently scheduled for October 24, 2006, at 2:30 p.m. the continuation of the contempt hearing for Defendant Ronald Holt. Counsel for Defendant Holt, the Securities and Exchange Commission, the Commodity Futures Trading Commission and the Court's Receiver have drafted a resolution of these contempt proceedings which may make further hearings unnecessary. The draft is not yet finalized for presentation to the Court. This counsel is currently in trial before this Court in the matter of United States v. Medina-Nevarez, No. CR05-0225-001-PHX-RGS, which trial may extend through the month of October. Counsel has conferred with Patrick Murphy, attorney for the Receiver, Timothy Mulreany, counsel for the Commodity Futures Trading Commission, and Marshall Gandy, counsel for the Securities and Exchange Commission and they have no objection to a continuance.
