Plaintiff Patrice Jerome and Defendants Midway Holdings, Inc., et al. file this
Expedited Joint Motion for Continuance of Dispositive Motion Deadline and respectfully
show the Court as follows:

l. On April 29, 2005, this Court set a dispositive motion deadline of October
17, 2005. [Docket N0. 44]
2. On September 27, 2005, this Court ordered the parties to conduct a
settlement conference with Magistrate Judge David K. Duncan. [Docket No. 48] The
parties are in the process of scheduling said conference.
3. In addition, the parties have agreed to conduct supplemental discovery, and
need time to resolve outstanding discovery disputes, which they are attempting to
negotiate between themselves prior to tiling dispositive motions.
4. So that the parties can concentrate their time and resources on exploring
settlement in accordance with the Court’s Order, and in resolving outstanding discovery
matters, the parties mutually request that the dispositive motion deadline be continued to
a date thirty (30) days from the conclusion of the settlement conference with Magistrate
Duncan, should said conference prove to be unsuccessful in resolving the entire matter.
5. Neither party has previously sought an extension of the dispositive motion
deadline in this case. [
6. This request is not sought for purposes of delay but so that justice may be
done.
WHEREFORE, the parties respectfully request that the Court grant their joint
motion and continue the dispositive motion deadline in this case until a date thirty (30)
days from the conclusion of the settlement conference, in the event that this matter does
not fully settle at the conference.
