22 Trustee Robert Patrick Abele and his counsel, Lucia Stark Williamson, LLP ("LSW")
23 hereby stipulate to the substitution of counsel from LSW to the law firm of Shughart Thomson
24 & Kilroy, PC ("STK"). This Substitution is necessitated bythe untimely death of Wavo’s lead
25 attorney, Tony Lucia, and as a result, LSW is unable to proceed with the prosecution of this
26 case.

1 The parties have not completed discovery. The parties did provide notice to this Court
2 of the progress of discovery on August 2, 2004 and December 1, 2004. Most notably, the
3 parties infornred the Court of that the voluminous documents in the Trustee’s possession had
4 been reviewed for privilege and made available to Defendants for their review. Defendants
5 have yet to review these records. In a letter dated December 14, 2004, Plaintiff agreed to
6 defense counsel ’ s request to extend the discovery deadlines. [Exhibit A] Thus, although Plaintiff
7 had noticed the depositions of the named Defendants, these depositions were postponed.
, 8 Despite further assurances, no stipulation for an extension was ever submitted.
9 Two months later, Mr. Lucia was diagnosed with several brain tumors and underwent
10 immediate treatment, including three weeks of whole brain radiation. Due to his failing health,
11 and ultimately the need to secure new lead counsel, the parties were unable to complete
12 discovery as set forth in the scheduling order. Thus, Plaintiff is not prepared to proceed to trial
13 which is currently scheduled to commence on December 13, 2005. As a result, Plaintiff
14 requests that this Court vacate the current trial date and, in addition, requests a status conference
15 for the purpose of establishing an amended discovery schedule. In an effort to minimize the
16 expected delay, LSW will take an active role in immediately sharing its knowledge and work
17 product with STK in this matter.
