Plaintiff Awareness Corporation ("Awareness") hereby moves this Court for an order in limine precluding defendants from reading the deposition of Dr. Barbara Timmermann, the Distributor Defendants' designated expert regarding the use of the herbal ingredients senna and wormwood, into the trial record, and to compel the Distributor Defendants to produce Dr. Timmermann at trial to give live testimony. Should Dr. Timmerman not be compelled to appear at trial, Awareness moves the Court for an Order permitting Awareness to conduct a trial deposition of Dr. Timmerman in Phoenix, Arizona. This motion is based on the following Memorandum of Points and Authorities, and the entire Court record in this case.

MEMORANDUM OF POINTS AND AUTHORITIES The Distributor Defendants have designated, for use at trial, the December 10, 2004 deposition of Dr. Timmermann. At the time of her deposition, Dr. Timmermann was a resident of the state of Arizona. Dr. Timmermann has since moved to Kansas, and is now outside of the subpoena powers of this Court. Based upon the Distributor Defendants' extensive designation of Dr. Timmermanns' deposition, Awareness believes that the Distributor Defendants intend to read Dr. Timmermann's deposition into the record, rather than make her available at trial. Awareness was not notified of the Distributor Defendants' plan not to produce their expert at trial prior to taking Dr. Timmermann's deposition for discovery purposes, and will therefore be prejudiced by the defendants' failure to produce her for trial. Awareness therefore requests that the Court preclude the defendants' use of Dr. Timmermann's deposition transcript at trial, and compel the defendants to make Dr. Timmermann available for live testimony. In the alternative, Awareness respectfully requests that the Court permit Awareness to conduct a trial deposition of Dr. Timmermann in Phoenix, Arizona prior to the trial. Awareness' prior deposition of Dr. Timmermann was a discovery deposition, and was not, nor was it intended to be, a deposition to be used at trial. To the extent Dr. Timmermann is not required to attend the trial, a trial deposition is necessary to ensure Awareness is able to effectively cross examine Dr. Timmermann. Awareness asks that this Court enter an Order in limine precluding the Defendants from utilizing Dr. Timmermann's December 10, 2004 deposition testimony in the place of live testimony and to compel the Distributor Defendants to produce Dr. Timmerman at trial. In the alternative, Awareness requests that the Court permit it to conduct a trial deposition of Dr. Timmermann in Phoenix, Arizona prior to trial. Pursuant to the Case
