Entiendo y estoy en acuerdo que es mi responsabilidad de leer y familiarizarme yo mismo con los acuerdos y procedimientos contenidos en esta guia. Yo entiendo que con ejecucion de empleo voluntario, cualquier o todo acuerdo o practicas pueden ser cambiadas a cualquier tiempo por la compania. La compania reserva el derecho de carabiar mis horas, sueldo y condiciones de trabajo a cualquier tiempo. A. Oh, yeah, he was in my crew, but that was his job, though. He wasn't driving a tractor, though, he was hired for a grader operator. Q. Okay. Who did that before he was hired? A. Another guy, an older guy. He had a heart attack and his doctor wouldn't let him come back to work, so I had to hire another guy to do that. Q. Do you remember his name? A. I don't remember his name. He had a four-way bypass, or something like that He was a good old boy, though. I don't remember his name. Fermin, something like that. I don't remember. Fermin. Fermin, yeah, I think that was it Something like that But, yeah, he had a heart attack one weekend. And he had open heart surgery and, yeah, his doctor wouldn't release him to come back to work. Q. Okay. My records that Eagle Produce provided me reflect that Fermin was laid oiTin December of'01. Do you recall that? A. I don't remember if thafs the time he had the heart attack. I don't know. Q. Were you in charge of the crew in December of '01? A. I don't know if that was me or Chester. Again, I don't know when Chester left.
