The parties stipulate and jointly request that the Court extend the time for completing discovery in this matter until January 31, 2006 as to the deposition of Brian Johnson. The parties make this request to allow plaintiff to subpoena Mr. Johnson; the defendant could not produce this out-of-state witness without a subpoena. The parties further stipulate and jointly request that the Court extend the time for plaintiff to respond to defendant's motion for summary judgment to February 28, 2006 so that Mr. Johnson's testimony can be made part of the record for purposes of that response.
