Comes now, the Plaintiff, Timothy Lee Ward, pro—per, pursuant to Rule 37

(A) and Local Rule 7.2 (J), of the Federal Rules of Civil Procedure, and

herby requests this Honorable Court’s assistance.

On April l, 2008, Plaintiff served Defendants with his “Request for
17
Production of Documents”. As of the date of this motion the Defendants still
18
have not responded to Plaintiff’s request. The Defendants have not requested
19
a time continuance to respond to Plaintiff’s Request for Production. The
20
Defendants have already filed a Motion for Summary Judgment. The Documents
21
are vital to Plaintiff’s case and his opposition to defendant’s motion.
