Under consideration is Plaintiff's Motion for Extension of Time to Comply, filed June 4, 2008 (#165). Plaintiff seeks an extension of time to submit discovery disputes for a discovery conference with the Court. Defendants have responded (#169) joining in the motion. Plaintiff seeks the extension, citing delays in completion and execution of the stipulation as cause. The Court finds good cause for the extension. In the Court's Order filed March 26, 2008 (#133), the parties were given deadlines to confer on remaining discovery disputes and to advise the Court of a need for a discovery conference. The parties have since stipulated (#167) to submit various materials for in camera review and Plaintiff has advised the Court of the remaining discovery disputes (#166) and Defendants have responded (#170) thereto. The Court will set a time for a telephonic discovery conference. In the meantime, the Court notes that although Defendants have filed a Notice re Submitting Materials for In Camera Review (#168), there are no attachments thereto, and nothing has been submitted for review. IT IS THEREFORE ORDERED that Plaintiff's Motion for Extension of Time to Comply, filed June 4, 2008 (#165) is GRANTED. Plaintiff's Notice of Discovery Disputes, filed June 10, 2008 (#166) shall be deemed timely filed. IT IS FURTHER ORDERED that within ten days of the filing of this Order,

Defendants shall file UNDER SEAL the materials identified in their Notice filed June 20, 2008 (#168). IT IS FURTHER ORDERED that the parties shall participate with the Court in a telephonic discovery conference on: Tuesday, July 29, 2008 at 9:00 a.m. Counsel for defendants shall be responsible for arranging for and initiating the conference call, including any necessary arrangements with prison personnel, and may contact the Court at (928) 329-4766.
