MEMORANDUM OF POINTS AND AUTHORITIES
Petitioner has Not Exhausted His State Remedies Mr. Simmons respectfully asks this Court to reimpose its stay so that he may pursue his unexhausted claims in state court, Rhines v. Weber, 544 U.S. 269, 273-274 (2005). In

Baldwin v. Reese, 541 U.S. 27, 32 (2004) the Court said a state prisoner must "fairly present" his claim in the appropriate state courts to alert them to the federal nature of the claims and see, Castillo v. McFadden, 399 F.3d 993, 1001 (9th Cir. 2005). In this case the superior court denied Mr. Simmons' Motion for Reconsideration but his claim does not end there. decision is subject to appeal. claims he must seek relief in the state court of appeals, Swoopes v. Sublett, 196 F.3d 1008, 1009-1010 (9th Cir. 1999). B.
