15 Comes now Plaintiff in Response to the La Paz Defendants notice of taking deposition of Pete
16 Heere, if taking a deposition at this time next the defendants will again be seeking a postponement of
17 Trial therefore plaintiff objects to this request.
18 Plaintiff in this matter filed his Complaint on November 12, 2003 and an Amended Complaint
19 on March 15, 2004. Defendants have motioned the Court to vacate the Jury Trial and extend all other
20 dates, a motion the Court denied, next the defendants motioned the Court for Leave to file Supplemental
21 Summary Judgment, a motion Plaintiffs have objected too, Now defendants have sent Notice of taking
22 deposition of Pete Heere only a month before trial. Plaintiffs feel that the La Paz defendants have had ample
23 time to prepare for this case, therefore object to this request
24 Under Robinson v. America's Best Contacts & Eyeglasses, 876 F.2d 596 (7th Cir. 1989).
25 “The district court should also take care to protect pro se plaintiffs from
consequences of confusion or delay attending the resolution of an in forma
pauperis petition"

1 ' Plaintiff will agree to wave his right to call Pete Heere to testify during the upcoming Jury
2 Trial if Mr. Heere is to be out of the Country.
3 Plaintiff prays the Court deny this & any further tactics the defendants intend to employ, in
4 there attempts to stall the resolution in front of a Jury as scheduled on June 13th 2002.
