Dear Judge Silver:
Pursuant to the Scheduling Order of the Court dated December 17, 2004 the
parties submit this joint letter concerning the status of settlement discussions and
discovery.
I Since their last report, the parties have discussed a settlement format that better
A addresses their respective needs. However, until dispositive motions are ruled upon,
settlement will be difficult. No dates have been set to resume mediation.
Discovery will be completed March 28, 2006. Motions to discover the notes of
Barbara Davis and obtain individual opt-in discovery are pending. Other discovery
disputes exist, but the parties hope to resolve them without the assistance of the Court.
