On Friday, November 11, 2005, Defendant sent to Plaintiff, through counsel by e-

2 mail, a draft stipulated jury instruction in accordance with the Court's directive at the 3 pretrial conference for the trial which has been set for February 28, 2006. Plaintiff received 4 the draft on November 14, 2005, the date when the parties were ordered to submit a joint 5 substantive jury instruction. Plaintiff has requested additional time to address Defendant's 6 draft, and Defendant does not oppose Plaintiff's request.
