16 undersigned counsel, and the plaintiff have agreed to an extension of time in which the defendant 17 may prepare his responses to plaintiff's Motion for Leave to File a Motion to Compel and 18 Sanctions, plaintiff's Motion to for Sanctions Against Defendant for Destruction of Evidence, 19 and Motion for Leave to file Second Amended Complaint and the proposed Second Amended 20 Complaint which were filed on December 6, 2005. Counsel for the parties have discussed the need for additional time for the undersigned 21 22 counsel for the defendant to respond to these motions, have agreed to extend the time for 23 response through and including January 23, 2006 or to such other date as established by the 24 Court. At present defendant's responses would be due on or before December 23, 2005, 25 assuming, that leave of court were not required. 26 Counsel for the plaintiff is aware of the contents of this stipulation, the proposed Order, 27 has authorized undersigned counsel to file the stipulation and proposed Order with the Court and 28 has waived his signature on this stipulation.
