JOINT REQUEST TO CORRECT FINAL PRE-TRIAL ORDER

The parties submitted to the Court a Pre-Trial Order on March 17, 2006 (Docket No. 56) for the Court's consideration. It was the parties intent to have that Final Pre-Trial Order signed by the Court. In early May 2006, the Court's staff requested undersigned counsel to send the Final Pre-Trial Form of Order in a different format than that which had been lodged with the Court at Docket No. 56. Undersigned counsel's secretary sent the Order which she believed had been presented to the Court on March 17, 20061 . Undersigned counsel's secretary inadvertently sent a "draft" Pre-Trial Order to the Court not

realizing that it was not the Proposed Pre-Trial Order submitted to the Court on March 17, 2006. As a result, this Court signed as the Final Pre-Trial Form of Order a "draft", not the one which both parties had agreed to and submitted to the Court. Accordingly, attached hereto as Exhibit "A" is the correct Final Pre-Trial Form of Order to which the parties had agreed and which they have submitted under the title: Corrected Final PreTrial Form of Order.
