Under consideration is Plaintiff's Motion for Extension of Time, filed December 20, 2005 (#60). Plaintiff seeks a 30 day extension of time, until January 23, 2006 within which to respond to the pending motion for summary judgment. Plaintiff cites difficulties in obtaining legal supplies as cause for the delay. Defendants have not responded. The Court finds good cause. In the meantime, on January 23, 2006, Plaintiff filed a second Motion for Extension (#63), stating that despite diligent efforts, Plaintiff will require until February 23, 2006 to complete his response. In light of the extension granted herein, this request is moot and will be denied. IT IS THEREFORE ORDERED that Plaintiff's Motion for Extension of Time, filed December 20, 2005 (#60) is GRANTED. Plaintiff shall respond to Defendants' Motion for Summary Judgment, filed October 12, 2005 (#53) within twenty days of the filing of this Order. IT IS FURTHER ORDERED that Plaintiff's Motion for Extension of Time, filed January 23, 2006 (#63) is DENIED as moot. DATED: February 3, 2006 _____________________________________ JAY R.
