To avoid the cost of briefing 18 attorneys' fee issues while the case was on appeal, the parties stipulated to an extension of the 19 briefing schedule until after the appeal had been completed, and the Court accepted the 20 stipulation on June 12, 2006. Dkt. #160. 21 The motion has now been pending for more than one year, and no decision on appeal

22 has been made. In order to clear the Court's docket of this old motion, the Court will deny 23 the motion without prejudice. Plaintiff may re-file the motion upon completion of the 24 appellate process, and briefing will occur on the schedule provided in the Court's local rules. 25 26 27 28
