Defendant, by counsel, notifies the court and Plaintiff that Jennifer Clemenshaw no longer works for the Arizona Department of Corrections, and therefore the Attorney General's Office can not ensure that she will be available to testify at trial. Ms. Clemenshaw remains on Defendant's witness list because Defendant would like her to testify. Ms. Clemenshaw stated to the Legal Assistant of undersigned counsel that she would not get paid by her current employer to come to court as a witness, and that she will not come to court unless she is served with a subpoena. Defendant will not serve her with a subpoena, but will attempt to persuade her to appear in court as a witness for both Plaintiff and Defendant.
