Defendants Leonard Bestgen, et al, filed an Appeal from the Judgment in the above-captioned matter. Their appeal was assigned Ninth Circuit Court of Appeals Cause No. 07-15586. In connection with that appeal, Defendants-Appellants ordered the full trial transcript (excepting Paul Richard's testimony which had been previously ordered and Lawrence J. Warfield's testimony which had been previously ordered). The Receiver-Plaintiff filed a Cross-Appeal which has been assigned Ninth Circuit Court of Appeals Cause No. 07-16377. Currently pending before the Ninth Circuit is the Receiver-Cross-Appellant's motion to consolidate these two appeals. If the Receiver's Motion to Consolidate is granted, it will be unnecessary to file a duplicate transcript of what has already been filed in this matter by the Appellants. The Receiver-Cross Appellant has discussed this matter with the court reporter. Because of the pending Motion to Consolidate, the court reporter has advised that he does not need to

prepare a duplicate set of transcripts for the Cross-Appeal until September 20, 2007 in order to meet the September 26, 2007 due date. If the motion to consolidate is granted before that time, the Cross-Appellant's transcript order will be cancelled as unnecessary. Counsel for the Receiver-Cross Appellant will advise the Clerk of the District Court if the transcript order is canceled based upon the foregoing reasons.
