The undersigned attorney was advised by the Clerk of the United States Court of Appeals for the Ninth Circuit that the Receiver-Cross-Appellant's motion to consolidate the appeal and cross-appeal arising from the above-captioned case has been granted and the order reflecting the granting of the motion was mailed on September 25, 2007. Accordingly, as earlier explained in the "Supplement to Transcript Form," filed by the Receiver-Cross-Appellant on August 27, 2007, it is unnecessary to file a duplicate transcript of what was already filed by the Appellants in this matter. The Court Reporter was notified on September 25, 2007
