19 Counsel for Steven Craig James move the Court for an order extending the
deadline for filing the Memorandum Re: Merits requested by the Court in its July 24,
1 I 2006, order. The Memorandum is due to be filed on March 5, 2007, and we ask for an
i extension through March 21, 2007.
2 We have discussed this request with Robert Gorman, counsel for Respondents,
2 who has authorized us to tell the Court that he has not objection. I
2 A The amount of additional time requested -- 16 calendar days -- is less than the
2 I amount of time tl1at, in the last tive weeks counsel for James were ill (one with

1 pneumonia, one with the flu) and unable to work. Additionally, the request will allow
2 lead counsel, Mr. Lowenthal, who has a full-time teaching load at Arizona State
3 University this semester, the benefit of the schoo1’s Spring break to complete the
4 memorandum for which he is undertaking the lion’s share of the responsibility.
5 We avow that this motion is in the interests of justice and not made for purposes of
6 delay.
