In response to Plaintiff' Motion to set a trial date, Defendant Mesa General s asserts that it would be more appropriate for this Court to simply set a status conference after ruling on the pending motion for summary judgment. As set forth in the previously filed Motion to Extend Discovery Deadlines, MGH anticipates that this Court will need to assist the

parties in resolving discovery disputes before discovery can go forward. The discovery disputes

stem primarily from Plaintiff' misunderstanding of the discovery and deposition process. A s status conference may be helpful in this regard. Assuming this Court grants the motion for summary judgment, no trial date will be necessary. If the pending motion is denied, then the parties require additional time to complete discovery. Either way, it would be premature to set a trial date at this juncture.
