12 On or about February 2, 2004, the United States of America ("the government") applied
13 to this court for an order extending for sixty days the time within which to give notice of its
14 intent to institute administrative forfeiture proceedings against 1984 Ford E350 Econoline
‘ 15 Cutaway, seized on July 11, 2003. The application was made pursuant to 18 U.S.C.
16 §983(a)(1)(C) and (D). The Court granted this Order under seal for reasons stated in the motion
17 by the government.
18 On September 7, 2005, the Court entered an order setting a Status Conference for September
19 27, 2005 at 9 am. Plaintiff presents this Status Report in compliance with that order and will
20 appear at the hearing unless the hearing is deemed moot as the result of this Report, and
21 cancelled by the CoLu·t.
22 Pursuant to the Order of this Court dated March 4, 2005, the Notice of Administrative
23 Forfeiture was published and served, pursuant to the procedures adopted by DEA. No party
24 made a claim in the administrative forfeiture proceeding and the vehicle was declared forfeited
25 by DEA on or about July 24, 2004. Please see the attached DEA Declaration of Forfeiture,
26 incorporated by this reference as Exhibit A. The vehicle was subsequently liquidated on or about
27 November 21, 2004. -

1 With respect to this matter, when no further request for extension was made by or on behalf
2 of DEA, the issues before the Court were finally resolved. At this point, the asset having been
3 declared administratively forfeited, this matter should be closed.
