In response to this Court's order of April 4, 2006, regarding clarification of the form of class notice and implementing order, the parties jointly report to the court as follows: 1. The parties have agreed to include New Jersey in the proposed class. To

effectuate this, plaintiffs must first file an amended complaint that adds "Allstate New Jersey Insurance Company" to this action as a named defendant, and the parties have agreed to cooperate in filing the necessary pleadings and proposed orders to effectuate that addition by stipulation. 2. The parties have agreed that Rosenthal & Company shall be the class

administrator. 3. On April 7, 2006, the administrator was provided the list of potential class

members (approximately 16,000 persons) in electronic format. The parties propose that the notice be mailed by the administrator on April 28, 2006. The parties have clarified both the form of Notice of Pendency of Collective Action and Right to Join and the proposed Implementing Order to reflect these minor changes (and a change to the consent form permitting e-mail notification to opt-in plaintiffs that their form has been filed with the Court) and attached them hereto as Appendixes.
