Fair Labor Standards Act ("FLSA") lawsuit against Allstate for alleged failure to pay overtime compensation to adjusters in states other than California. INTRODUCTION

You are receiving this Supplemental Notice because you submitted a timely CONSENT TO JOIN COLLECTIVE ACTION in this matter, but Allstate's records indicate that you did not work as an adjuster based outside the state of California at any time on or after October 1, 1999. The collective action in this matter specifically excludes adjusters for the time they worked in the State of California. (Enclosed is a copy of the original Notice, which makes that exclusion clear.) If the above information is accurate, then you are not eligible to be part of the action. 2.
YOUR ALTERNATIVES

If Allstate's records are accurate, then you are not eligible to participate in this matter. In that case you do not need to do anything. Your consent will not be filed with the Court and you will not be bound or affected by anything that happens in this lawsuit. If you believe Allstate's records are incorrect, and contend that you worked as an adjuster based in a state other than California at any time on or after October 1, 1999, you MUST respond to the plaintiffs' counsel in writing at the address indicated below and advise them when and where you were employed by Allstate as an adjuster in any state other than California. THIS WRITTEN RESPONSE MUST BE POSTMARKED NO LATER THAN [DATE - 30 DAYS]. You may use the enclosed form to provide that information, which will then be reviewed with Allstate. NOTE: TO BE ELIGIBLE TO PARTICIPATE IN THIS ACTION, YOU MUST HAVE WORKED IN OR BEEN ASSIGNED TO A NON-CALIFORNIA MCO; YOU ARE NOT ELIGIBLE TO PARTICIPATE IN THIS ACTION MERELY BECAUSE YOU MAY HAVE BEEN TEMPORARILY ASSIGNED TO WORK OUTSIDE OF CALIFORNIA.
