ORDER Pursuant to the discussions among the Court and counsel at the Case Management/Status Conference held on September 12, 2007, IT IS ORDERED that defendant Allstate Insurance Co. shall have through October 3, 2007 in which to file an appropriate motion concerning the issue of whether the future withdrawal from this action by any of the remaining named or opt-in plaintiffs should be with prejudice, without prejudice, or with conditions. IT IS FURTHER ORDERED that defendant Allstate Insurance Co. shall have through October 3, 2007 in which to file an appropriate motion concerning the issue of whether opt-in plaintiff Ed Czarnecki's requested withdrawal from this action should be stricken, or granted with prejudice, without prejudice, or with conditions. IT IS FURTHER ORDERED that response and reply briefs regarding defendant Allstate Insurance Co.'s motions shall be filed in compliance with the time limits of LRCiv 7.2(c) and (d).

IT IS FURTHER ORDERED that the plaintiffs' lead liaison counsel, Kelly McInerney, shall immediately provide a copy of this order to counsel for opt-in plaintiff Ed Czarnecki.1 DATED this 12th day of September, 2007.
