The motion of Gail Gianasi Natale, Esq., counsel of record, to tile a late
opening brief, is granted. The Clerk is instructed to file appellant’s opening brief h
received on January 3, 2006.
The Court is in receipt of counsel’s motion to withdraw as counsel of record
under Anders v. Cal§form`a, 386 U.S. 738 (1967), and it is referred to the panel
assigned to hear the merits of this appeal. The panel will conduct an independent
review of the record. See Perzsrm v. Ohio, 488 U.S. 75, 82-83 (l988). After it
conducts its review, the merits panel will determine whether counsel may be
, allowed to withdraw and whether new counsel will be appointed. See id. at 83.1
'Counsel is reminded that the motion requesting permission to withdraw as
counsel of record must affirm that counsel conducted a conscientious, diligent and
I thorough evaluation of the case, before concluding that the appeal is frivolous.

February 28, 2006. On or before March 30, 2006, appellee shall file the answering

files the answering brief, the optional reply brief will be due within 14 days after
service of the answering brief.
