Regarding your motion for new trial as well as your 2255 motion, please advise in writing whether by your
motions, you intend to waive the attorney/ client privilege regarding your communications with trial counsel,
John Rood and appeal counsel, Anders Rosenquist. Please identify specific areas and issues that you would
allow your prior lawyers to discuss in order to address the claims made against their prior representation
of you.
Without a specific waiver by you, I cannot make a motion to the Court to seek an order setting forth the
scope ofthe waiver in this matter. Without some detail in a letter from you, I cannot request an order from
the Court by which your prior counsel will feel comfortable in discussing the issues you raise to allow me
to adequately respond to your allegations. Therefore, I am requesting that you precisely state the areas you
will or will not allow your prior counsel to reveal to the government for the purpose of responding to your
ineffective assistance of counsel claims.
Please respond at your earliest convenience so that further delays are avoided- Thank you for your
cooperation.
