NOTICE OF CONFLICT AND REQUEST FOR RESOLUTION

Michael B. Bernays, counsel for Thomas Georgatos in Gila County Cause Number CR 2007-0005 consolidated with CR 2007-0747 and for Margaret Molter in Cause Number CR 04-00539-PHX-MHM hereby notifies the Gila County Superior Court and the United States District Court that a conflict exists in his scheduling and requests that the Courts communicate with each other to resolve that conflict. Counsel cannot be both in Globe, Arizona trying the Georgatos case and in Phoenix, Arizona doing the sentencing in the Molter case at the same time. In Gila County Superior Court, Cause Number, CR 2007-0005 consolidated with CR 2007-0747 Tom Georgatos is charged with multiple counts of dangerous crimes against children involving both the sexual molestation of minors and with providing minors with controlled substances. Mr. Georgatos is in custody. The trial is scheduled to begin January 29, 2008, in Globe, Arizona and is anticipated to last 4-5 days. Margaret Molter is scheduled for sentencing on her plea to one count of Conspiracy in violation of 18 U.S.C. §371 in the United States District Court on Wednesday, January

20, 2008. Molter is one of three defendants being sentenced on that date. Molter is out of custody. The sentencing is scheduled to last one day. Counsel has been advised that neither Court is ready to change either matter to accommodate counsels conflict in the scheduling. Counsel cannot be in both places at once, and would therefore request the Courts to talk to each other and resolve this conflict. The Georgatos matter is assigned to the Honorable Peter J. Cahill, Gila County Superior Court, 1400 East Ash, Globe, Arizona, 85501; phone number 928-425-3231, extension 8686. Margaret Molter's case is assigned to the Honorable Mary H. Murguia, United States District Court for the District of Arizona, 401 West Washington, Phoenix, Arizona, 85003; phone number 602-322-7580.
