At a hearing on December 16, 2005, the Court inquired of the parties as to the legal basis for the assertion that a conviction under 18 U.S.C. §§ 922(g)(1) and 924(e) the Armed Career Criminal Act carries a maximum sentence of life imprisonment. Although the statute is silent as to the statutory maximum sentence, both the Supreme Court and the Ninth Circuit have held that the statutory maximum sentence for a violation of the Armed Career Criminal Act is life imprisonment. E.g. United States v. Custis, 511 U.S. 485, 487 (1994) (limiting the ability of a defendant to collaterally attack a predicate felony); United States v.
