Upon reading the foregoing Motion for New Sentencing and Presentence Report filed

March 11, 2008 [#186], good cause thereby appearing and there being no objection by the

government,

IT IS HEREBY ORDERED granting Defendant's Motion and setting re-sentencing for
14
the 16th day of June , 2008 at the hour of 2:30 p.m. before this Court.

IT IS FURTHER ORDERED that a Presentence Report be prepared. (1) Any objections
16
to the Presentence Report shall be filed no later than 14 days after receiving the Presentence
17
Report pursuant to Fed.R.Crim.P. 32(f)(2); (2) Any response to the objections to the Presentence
18
Report shall be filed no later than 11 days after receiving the objections; (3) Any sentencing
19
memorandum shall be filed no later than five business days prior to sentencing; (4) Any party
20
seeking to continue a sentencing date shall file a Motion to Continue no later than two business
21
days prior to the date of hearing. Additionally, counsel shall telephonically notify chambers
22
when sentencing is within two business days; (5) Failure to comply with this Order may result
23
in the imposition of sanctions.
