Petition to Revoke Supervised Release
COMES NOW PROBATION OFFICER Matt L. Bass presenting an official report on LUIS
ARNIANDO HIGUERA—LLAMAS who was committed to the Bureau of Prisons on December 20, 2004
by the Honorable Earl H. Carroll presiding in the District Court of Arizona. A one year period of
supervised release was imposed, and supervision commenced upon the offenders discharge from
imprisonment on March 1, 2006. In addition to the general terms and conditions adopted by the court,
the offender was ordered to comply with the following special conditions:
1. if deported, you shall not re—enter the United States without legal authorization.
Luis Armando HIGUERA-LLAMAS was convicted of Re-entry After Deportation, in violation of 8 USC
§1326(a), a class E felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. Violation of Standard Condition No. 1: "You shalt not commit another federal, state, or iocai
crime during your term of supervision. "
On December 25, 2006, Higuera-Liamas committed a federal crime, Attempted Re-entry after
Deportation, in violation of 8 USC §1326(b)(1) when he illegal re-entered the United States and was
arrested by law enforcement authorities in San Luis, Arizona. It was determined the offender had not
obtained the express consent from the Secretary of the Department of Homeland Security to re-enter
the United States. An indictment filed January 16, 2007, in the U.S. District Court, District of Arizona,
case no. 07CR00045-PHX-JAT, charged him with attempted re-entry after deportation, a felony. Grade
B vioiation.
B. Violation of Special Condition No. 1: "if deported, you shall not re-enter the United States without
