Cherie Vigil, through counsel, moves this Court for an order dismissing the case against
17
her with prejudice. On February 17, 2005, this Court granted the prosecution's motion (Doc.
18
69) to dismiss the indictment against Ms. Vigil without prejudice. Ms. Vigil is innocent of any
19
wrongdoing in this case. It is the understanding of counsel undersigned that co-defendant
20
Melissa Femandez admitted to committing the crimes of which Ms. Vigil was accused and
21
admitted that she committed them without Ms. Vigi1’s knowledge or consent. Ms. Fernandez
22
was sentenced pursuant to her guilty plea on August 15, 2005 (Doc. 96). It is therefore
23
respectfully submitted that the interest of justice require that this case be dismissed with
24
prejudice as to Ms. Vigil.
